5.1 Product information

We make every effort to provide accurate descriptions, images, specifications and pricing for all products. However, we do not warrant that product descriptions, images or other content are accurate, complete, reliable, current or free of error.

Our quality standards are as follows:

• All apples are picked by hand at optimal ripeness
• Naturally grown
• No artificial wax, chemicals or preservatives
• Strict quality control before packaging

Because this is fresh produce grown without wax or coatings, some variation is normal and is not a defect:

• Size and appearance may vary naturally between fruit
• Seasonal availability affects the range on sale
• Weather conditions may affect harvest timing
• Minor cosmetic variations are normal

5.2 Pricing

All prices are listed in Indian Rupees (INR) and include applicable taxes unless otherwise stated. We reserve the right to modify prices at any time without prior notice, but such changes will not affect orders that have already been confirmed and paid for.

• Delivery charges, where they apply, are calculated separately at checkout
• Promotional pricing is subject to its own terms and conditions
• Price errors will be corrected and affected customers notified
• We reserve the right to cancel orders placed at an erroneous price

5.3 Product availability

Product availability is subject to seasonal harvests, weather conditions and inventory levels. We will notify you if any ordered products become unavailable, and offer either a suitable alternative or a full refund.

6.1 Order process

When you place an order through our Service, you are making an offer to purchase the products. We reserve the right to accept or decline your order for any reason. The contract is formed when we confirm the order.

3. Receive order confirmation with tracking information

6.2 Payment terms

Payment is required in full at the time of order placement. All payments are processed through secure, encrypted payment gateways. We accept:

• Credit cards, including Visa, MasterCard, American Express and RuPay
• Debit cards from all major Indian banks
• UPI, including Google Pay, PhonePe, Paytm and BHIM
• Net banking with all major Indian banks
• Digital wallets, including Paytm and Amazon Pay

6.3 Payment security

All transactions are SSL encrypted and compliant with PCI DSS. We do not store credit card information on our servers. Payment processing is handled by certified payment gateways, and fraud detection systems monitor all transactions. Your payment data is protected in accordance with our Privacy Policy.

6.4 Order confirmation and processing

Once your payment is successfully processed, you will receive an order confirmation email containing your order details, estimated delivery time and tracking information.

Order acceptance. We reserve the right to refuse or cancel any order for reasons including, but not limited to, product availability, errors in pricing or product information, suspected fraudulent transactions, or violation of these Terms.

7.1 Delivery terms and conditions

• Delivery times are estimates and are not guaranteed
• Delays may occur due to weather, festivals or other unforeseen circumstances
• Someone must be available to receive the delivery
• Proper identification may be required for delivery
• We will attempt delivery two or three times before returning the products
• The delivery address cannot be changed once an order has been shipped

7.2 Risk of loss

Risk of loss and title for products purchased pass to you upon delivery to the carrier. We are not responsible for delays, damages or losses that occur during shipping, though we will assist in resolving such issues with the carrier.

8.1 Returnable conditions

• Products damaged during shipping
• Products spoiled upon arrival
• Wrong products delivered
• Quantity discrepancies
• Quality issues verified by our team

8.2 Return requirements

• Report issues within 24 hours of delivery
• Provide clear photographs of the products
• Maintain products in their original packaging
• Provide the order number and delivery details
• Cooperate with our quality assessment

8.3 Refund policy

Approved returns receive a full refund, including any original delivery charge, to the original payment method. Timings by method are:

5 to 7 business days

UPI and digital wallets:

2 to 3 business days

Net banking:

3 to 5 business days

9.1 Account registration

Account closure. Upon termination, you will lose access to your order history, saved preferences and any unused account credits. Pending orders will be fulfilled in accordance with these Terms.

The Service and its original content, features and functionality are and will remain the exclusive property of Ambertale Farms and its licensors, and are protected by copyright, trademark and other intellectual property laws. Protected content includes:

• Website design, layout and graphics
• The Ambertale Farms name, logos and trademarks
• Product descriptions, images and videos
• Software, applications and source code
• Marketing materials and promotional content
• Database compilation and organisation

10.2 Content you submit

By submitting content to our Service, such as reviews, comments or feedback, you grant us a non exclusive, royalty free, perpetual and worldwide licence to use, modify and display that content for business purposes. Content must meet these guidelines:

• Content must be original and truthful
• No copyrighted material without permission
• No offensive, defamatory or illegal content
• We reserve the right to remove inappropriate content

10.3 Copyright infringement

We respect intellectual property rights and expect our users to do the same. If you believe your copyrighted work has been infringed, please contact us immediately with details of the alleged infringement.

11.1 Force majeure

We shall not be liable for any failure to perform our obligations under these Terms if such failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, strikes or internet service failures.

11.2 Indemnification

You agree to indemnify and hold harmless Ambertale Farms Private Limited from any claims, damages or expenses arising from your use of our Service, your violation of these Terms, or your infringement of any intellectual property or other rights.

12.1 Termination by the Company

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms. Grounds for termination include:

• Violation of these Terms and Conditions
• Fraudulent or suspicious activity
• Repeated chargebacks or payment disputes
• Abusive behaviour towards staff or other customers
• Misuse of our platform or services
• Legal or regulatory requirements

12.2 Termination by the user

You may terminate your account at any time by contacting our customer service team. Upon termination, your right to use the Service will cease immediately.

12.3 Effect of termination

Upon termination, all rights and licences granted to you will immediately cease, and you must discontinue all use of our Service.

• Outstanding orders will be fulfilled or refunded
• Account data may be retained as required by law
• Provisions regarding liability and indemnification survive termination
• Unpaid amounts remain due and payable

13.1 Applicable law

These Terms and Conditions are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

13.2 Jurisdiction

Any disputes arising from these Terms or from your use of our Service shall be subject to the exclusive jurisdiction of the courts located in Shimla, Himachal Pradesh, India, namely the District Courts of Shimla and the High Court of Himachal Pradesh.

Before initiating any legal proceedings, we encourage you to contact our customer service team to resolve disputes amicably. Many issues can be resolved through direct communication.
